Offenses that Lead to an Arrest in New Jersey

Last updated 6 years ago

The severity of an offense and the suspect’s criminal history can increase the likelihood of a trip to the slammer. Thankfully, education can help citizens avoid imprisonment. Review the following New Jersey criminal offences to stay out of trouble with the law.

Assault: The state of New Jersey splits this offense into two subsections. “Simple assault” refers to an attempt to injure another person, negligent harm caused by a weapon, or the threat of physical violence. “Aggravated assault” refers to an attempt to cause dangerous injury to another person and intentional attacks with a deadly weapon. Any assault charge (even “simple assault”) against a police officer, fireman, and education employee is automatically treated like an “aggravated assault.”

Possession: It is illegal to possess any controlled substance without the explicit permission of a certified medical professional. Those in possession of Schedule I, II, III or IV drugs can face jail time and an automatic fine up to $35,000. Similarly, possession of a Schedule V drug carries a risk for imprisonment and a fine up to $15,000. These offenses also incur at least 100 hours of community service if committed near a school.

Shoplifting: This offense encompasses actions beyond the simple grab-and-dash. For example, switching labels in order to avoid paying full price is considered a form of shoplifting. Stealing a shopping cart for personal use also constitutes shoplifting. New Jersey law allows any officer to detain persons who are suspected of this offense. New Jersey law officers can arrest suspected shoplifters without a warrant.
