Arrest or Summons

There are two basic ways for your journey through the criminal justice system to begin: An arrest or a court summons. If you are caught while committing a crime (or an officer believes that you were committing a crime), then you will be arrested. You may also be arrested if a grand jury has found enough reason to indict you for a crime. Sometimes, however, you are simply issued a summons ordering you to appear in court on a certain date.

Bail

Bail will be discussed during your first court appearance. According to New Jersey state law, everyone has the right to be considered for bail, and bail has to be set within half a day of an individual being charged. The state of New Jersey occasionally conducts investigations into a defendant’s personal situation in order to determine if allowing bail would pose a threat to the community at large or give the defendant the chance to escape. If the investigators believe either of those things to be true, then bail will be denied.

Processing

Many cases never go to trial at all, and are addressed during other pre-trial events. If you have a drug or alcohol addiction, then you may be sent to a rehabilitation program instead of prison. The prosecution may decide to downgrade or outright dismiss charges as a result of a plea deal or other decision. You may also qualify for a pre-trial intervention program. These programs usually mean that you aren’t convicted of the crime of which you are accused, but they do mean that you’ll be closely supervised by court officials.
